In accordance with the requirements of Articles 13, 14 and 21 of the General Data Protection Regulation (GDPR) and Section 26 of the German Federal Data Protection Act (BDSG), we hereby inform you about the processing of personal data provided by you as part of the application process and, if applicable, collected by us, and your rights in this regard. To ensure that you are fully informed about the processing of your personal data as part of the application process, please take note of the following information.
 
1. Responsible body in the sense of data protection law
 
The respective company of the JUWI Group that has advertised the vacant position is responsible for processing your personal data within the scope of the application process. You can find an overview of our locations and the companies of the JUWI Group here.
 
In the case of a speculative application, we will check in which JUWI Group company we can offer you a suitable position. In the event that your data is passed on to a specific company of the JUWI Group, we will then inform you of the responsible office and, if necessary, provide you with further information on data protection.
 
If your application is directed to a company of the JUWI Group outside Germany, you will receive further information on data protection from the respective company after receipt of your application, if necessary.

When contacting the data protection officer, please name the company to which your inquiry refers. Please refrain from enclosing sensitive information, such as a copy of an ID card, with your request.

2. Purposes and legal basis of processing
 
We process your personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG), insofar as this is necessary for the decision to establish an employment relationship with us. The legal basis for this is Article 88 GDPR in conjunction with Section 26 BDSG and, if applicable, Article 6 (1) lit. b GDPR for the initiation or implementation of contractual relationships. If, in individual cases, we receive special categories of personal data (e.g. information on a disability) from you and process it to establish an employment relationship with you, the legal basis for this is Art. 9 Para. 2 lit. b GDPR in conjunction with § 26 Para. 3 BDSG.
 
Furthermore, we may process personal data from you if this is necessary for the fulfillment of legal obligations (Art. 6 para. 1 lit. c GDPR) or for the defense of asserted legal claims against us. The legal basis for this is Art. 6 (1) lit. f GDPR. The legitimate interest is, for example, a duty of proof in proceedings under the General Equal Treatment Act (AGG).
 
If you give us express consent to process personal data for specific purposes (e.g. talent pool), the lawfulness of this processing is based on your consent in accordance with Art. 6 (1) lit. a GDPR, Section 26 (2) BDSG. Consent given can be revoked at any time, with effect for the future.
 
If an employment relationship arises between you and us, we may, in accordance with Art. 88 GDPR in conjunction with § 26 BDSG, further process the personal data already received from you for the purposes of the employment relationship, insofar as this is necessary for the implementation or termination of the employment relationship or for the exercise or fulfillment of the rights and obligations of the representation of the interests of the employees resulting from a law or a collective agreement, a company or service agreement (collective agreement).
 
3. Categories of personal data
 
We only process data that is related to your application. The personal data processed can be categorized into general personal data, such as master, address and contact data; physical characteristics, such as gender; data on formal qualifications and general skills, such as school, training and occupation; where applicable, information on social activities and, where applicable, other data that you provide to us in connection with your application.

4. Sources of the data
 
We process the personal data that we receive from you by mail or e-mail in the context of contacting you or regarding your application, or that you have transmitted to us via our applicant portal on juwi.com.
 
5. Recipients of the data
 
We disclose your personal data within the JUWI Group - JUWI GmbH and its affiliated companies pursuant to §§ 15 et seq. AktG (German Stock Corporation Act) - exclusively to those areas and persons who need this data to fulfill contractual and legal obligations or to implement our legitimate interests.
 
Your personal data is processed on our behalf on the basis of order processing contracts pursuant to Art. 28 GDPR. In these cases, we ensure that the processing of personal data is carried out in accordance with the provisions of the GDPR. The categories of recipients in this case are providers of application management systems and software.
 
Otherwise, data is only transferred to recipients outside the company if legal provisions allow or require this, the transfer is necessary for the fulfillment of legal obligations, or we have received your consent

6. Transfer to third countries
 
If a transfer of personal data to third countries outside the EU/EEA is necessary (e.g. for the initiation of an employment relationship) or if it is carried out by our processors, further appropriate safeguards are required to ensure a level of data protection that complies with the GDPR. Unless there is an exceptional case under Article 49 of the GDPR, we ensure that appropriate safeguards are in place under Article 46 of the GDPR (e.g., standard contractual clauses under Article 46(2)(c) of the GDPR). These oblige the recipient of the data in countries outside the EU to process the data in accordance with the level of protection in Europe.

7. Duration of data storage
 
We store your personal data as long as this is necessary for the decision on your application. Your personal data or application documents will be deleted a maximum of six months after the end of the application process (e.g. the announcement of the rejection decision), unless longer storage is legally required or permitted. We store your personal data beyond this only insofar as this is required by law or in the specific case for the assertion, exercise or defense of legal claims for the duration of a legal dispute.
In the event that you have consented to a longer storage of your personal data, we will store it in accordance with your declaration of consent.
If, following the application process, an employment relationship, apprenticeship or trainee relationship is established in a company of the JUWI Group, your data will initially continue to be stored, insofar as this is necessary and permissible, and will then be passed on to the HR department for storage in a digital personnel file.

If applicable, you will receive an invitation to join our talent pool following the application process. This allows us to continue to consider you in the future for suitable vacancies in our selection of applicants. If we have your consent to do so, we will store your application data in our talent pool in accordance with your consent or, if applicable, future consents.

8. Your rights
 
Every data subject has the right to information under Article 15 of the GDPR, the right to rectification under Article 16 of the GDPR, the right to erasure under Article 17 of the GDPR, the right to restriction of processing under Article 18 of the GDPR, the right to notification under Article 19 of the GDPR and the right to data portability under Article 20 of the GDPR.
In addition, you have the right to lodge a complaint with a data protection supervisory authority pursuant to Art. 77 GDPR if you believe that the processing of your personal data is not lawful. The right of appeal is without prejudice to any other administrative or judicial remedy. If the processing of data is based on your consent, you are entitled to revoke your consent to the use of your personal data at any time in accordance with Art. 7 GDPR. Please note that the revocation is only effective for the future. Processing that took place before the revocation is not affected. Please also note that we may have to retain certain data for a certain period of time in order to comply with legal requirements (see section 7 of this data protection information).
 
Right of objection
 
Insofar as the processing of your personal data is carried out for the protection of legitimate interests pursuant to Art. 6 Para. 1 lit. f GDPR, you have the right, pursuant to Art. 21 GDPA, to object to the processing of this data at any time for reasons arising from your particular situation. We will then no longer process this personal data unless we can demonstrate compelling legitimate grounds for the processing. These must override your interests, rights and freedoms, or the processing must serve the assertion, exercise or defense of legal claims.

9. Necessity of the provision of personal data

The provision of personal data in the context of application processes is neither required by law nor by contract. You are therefore not obliged to provide information about your personal data. However, please note that these are required for the decision on an application or the conclusion of a contract relating to an employment relationship with us. If you do not provide us with any personal data, we will not be able to make a decision regarding the establishment of an employment relationship. We recommend that you only provide personal data in your application that is required to complete the application.
