Data Protection Notice for Candidates

1. Data Controller

In accordance with obligations prescribed by the EU General Data Protection Regulation 679/2016 (“GDPR) and any other applicable legislation and regulations on the protection of personal data, including Legislative Decree 196/2003 (jointly, the “Privacy Regulation”), we hereby inform you that our company, JUWI Energie Rinnovabili S.r.l., with registered office in via via Giovanni Battista Pirelli 30 – 20124 Milano (MI), (hereinafter the “Data Controller”), may process your personal data following purposes and methods indicated below.

2. Purpose of Data processing

The purpose of personal data processing is to achieve the following:

a) Selection and resumes’ management, that are sent to the Data Controller,
b) Management of the interview and selection process.

The processing of data for the purposes indicated will take place for as long as necessary to achieve the purposes described above and thereafter for the fulfillment of any legal obligations (also concerning the obligations provided for by the regulations on anti-money laundering and anti-terrorism, referred to in D. Lgs. 231/2007 and D. Lgs. 109/2007 and subsequent amendments or additions) or for the need to protect a legitimate interest of the Data Controller. Data will be deleted or anonymized by the Data Controller once the purposes described above are achieved.
 

3. Legal basis for Data processing

The provision of data is necessary for the performance of pre-contractual obligations related to the review of resumes and the management of the interview and selection process.

4. Personal Data

In order to achieve the purposes stated in Art. 1, we may collect the following data: title, name and surname, academic qualifications, past and current work experience, home or residence address, telephone number, e-mail address, extracurricular activities. The collection of all personal data listed above is purely eventual and will take place only where strictly necessary in relation to the purposes of data processing.

5. Methods of Data treatment

Data processing is carried out both by hardcopy means and by informatic and electronic means, and it is carried out by the Data Controller in order to ensure the security and confidentiality of the data in accordance with the provisions of the Privacy Policy. All technical, IT, organizational, logistical and procedural security measures provided by the Privacy Policy will be adopted.

6. Data Retention

Your personal data, subject of data processing for the above purposes, in the event of a negative outcome of the selection process, will be retained for a maximum period of 6 months and destroyed or anonymized at the end of this period.

7. Consequences of non-disclosure of personal data

Non-disclosure of your personal data processed by the Data Controller prevents the evaluation of your application by the Data Controller.

8. Communication of data to third parties

Personal data collected may be communicated to:

(i) Public Administrations;
(ii) companies, entities or consortia, experts who provide the company with advice and/or services to support the recruitment process or who carry out secondary activities for our company and in particular by our lawyers and consultants in general;
(ii) companies, entities or consortia, experts who provide the company with advice and/or services to support the recruitment process or who carry out secondary activities for our company and in particular by our lawyers and consultants in general;
(iii) subjects to whom the right to access your personal data is recognized by provision of law or secondary or EU regulations;
(iv) subjects to whom the communication of your personal data is necessary or is otherwise functional to the establishment of the contractual relationship;
(v) companies belonging to the Data Controller's group.

If data processing need to be carried out by third parties on behalf of the Data Controller, the Data Controller shall ensure an appropriate data protection agreement signed by both parties and the Data Controller appoints such third parties as data processors in accordance with the Privacy Regulations. A list of data processors can be obtained by making a request to the Data Controller.

9. Data transfer abroad

Personal data may be disclosed to third parties located outside the European Union exclusively in compliance with the provisions of the Privacy Regulations.

10. Rights of the involved party

You may exercise the following rights at any time:

(i) Access right to your personal data;
(ii) right to obtain rectification or cancellation of data or restriction of personal data processing;
(iii) right to data portability (for electronic data);
(iv) right to withdraw consent to data processing at any time;
(v) right to object at any time, related to your particular situation, to the processing of personal data.
